There are numerous opportunities as well as challenges associated with establishing and conducting businesses in a developing and evolving nation such as Zambia. One of the many challenges which businesses face while in Zambia is corruption and unethical practices. Dr. Rajan Mahtani is a famous businessman living in Zambia and he is a prime example of how honest and ethical businessmen are facing challenges at the hands of corrupt politicians, government officials as well as law makers.
Mumba Malila is an honourable justice at the Supreme Court Zambia. Recently, he released a testimony in which he discussed about the various illegal practices and how they penetrated to the highest government offices such as the high courts of Zambia. Among many of his revelations in the testimony, one which was most talked about was the case of Dr. Rajan Mahtani in 2012. In this case, the final judgement was given against Dr. Mahtani’s claims. However, the testimony throws new light on the case and reveals that the case was actually against the interests of the public policy. It was influenced by political undertones and the decision making was influenced by some corrupt yet powerful politicians and businessmen who gained from the unethical judgement.
According to the testimony, Justice Mumba Malila, who was the Attorney General during that time, requested the case to be made null and void due to its irrelevancy. However, no such actions were taken and the real facts associated with the case were just swept under the rug. These incidents clearly highlight the level of corruption and unethical practices in Zambia. With this new testimony from the judge, it is expected that the case will be re-opened as the facts and evidences will be re-visited and a correct judgment is expected now.
