The case of Portland Cement Zambia is known to almost every individual associated with the Zambian corporate. PCZ is a cement manufacturing company for which Dr. Mahtani is fighting a case at the Lusaka High Court. Dr. Rajan Mahtani claims to be the legal owner of the factory. The case has been running at the Lusaka HC for more than a decade; and during this period numerous changes took place except one, a final verdict which would announce the fate of the cement factory.
The judge currently overseeing the case recently made a shocking verdict wherein Dr. Mahtani lost the case. However, this was a surprise for most of the people as majority of the evidences and testimonials were in favour of Dr. Mahtani. It was found that the judge, Justice Nkonde, ignored majority of the prime evidences when considering the claims of both parties. These include critical documents submitted by Dr. Mahtani’s team such as signed shareholder’s agreement, financial exhibits as well as independent auditor’s report which clearly stated that Dr. Rajan Mahtani is the sole joint venture partner of the factory. It was quite clear that the judgment was misdirected and skewed. This disregard of the documents is certainly a disregard of the law and order, which is certainly not expected.
Rather than arguing with the judge and making the matter worse, Dr. Rajan Mahtani took the right step and approached the ‘higher court of appeal’ against the verdict made by the Lusaka High Court Judge. In this appeal, all details regarding the verdict, evidences and other facts associated with the case has been mentioned. Considering this appeal has been made to the highest court of Zambia, Dr. Rajan Mahtani is now hoping to get transparent and true justice this time.
