Since the final verdict from the Court of Appeal judge, Dr. Rajan Mahtani has been working towards the betterment of the Portland Cement Zambia factory. The factory was taken away from him in an illegal manner more than a decade ago. Then started one of the major legal battles in Dr. Rajan Mahtani’s career wherein he approached two major courts in Zambia. The first was high court in Lusaka where the case was originally established. While it was an easy and straightforward case, challenges within the court itself resulted in the case being dragged for more than a decade. Despite this long case proceedings, the final judgement coming from the Lusaka High Court was controversial as Ventriglias were given only shareholding and ownership over the factory without having any evidence.
After this injustice, Court of Appeal was approached. The higher Court of Appeal provided its final judgement on 31st January 2019, around nine months after Dr. Rajan Mahtani had approached with his re-appeal. Justice Mwinde was the authority who gave the final verdict on behalf of the Zambezi Portland Cement factory. According to his verdict, Dr. Rajan Lekhraj Mahtani is the sole owner of the factory. This decision came after a series of evidences and testimonials shared by the court to the media and public. One of the major evidences was the document showcasing financial transaction between Dr. Rajan Mahtani owned Finsbury Investments and Zambezi Portland Cement factory. This financial transaction was worth 1 billion kwachas and it officially covered the entire value of the share capital which Dr. Rajan Mahtani owned of Portland Cement Zambia. This was further confirmed by the original shareholders agreement established in the year 2007. This agreement clearly indicated takeover of 58 percent shares of the factory by Dr. Rajan Mahtani and it also confirmed that Dr. Mahtani did not owe any further costs.
Based on these evidences, it is clearly established that Dr. Mahtani is the actual owner of the Portland Cement Zambia factory.
